MINUTES OF ANNUAL GENERAL BODY MEETING

HELD ON 14 NOV 2021

 

 

1.  A total of 33 members attended the meeting today and one of them at Ser No 22, Sh Uday Sehgal attended as Son of Sh Harsh Sehgal who could not come due to personal reasons. Lt Col LS Bedi and Sh Gaurav Satot at Ser No 28 and 29 came but refused to sign the register. In fact Lt Col LS Bedi was present throughout the meeting and also took pictures/videos on his mobile phone. The members who were present are witness to this whole episode.

2. The President extended a warm welcome to all members present and sought permission from the house to commence the proceedings. At the outset, the house was informed that the children of Society with the help of Miss Prerna of G Block had recently organized a donation camp of used items to help the needy people in the neighborhood and it was a great success. The house on today being children’s day applauded their efforts.

3. As per the agenda, details of expenditure under major heads since 01 Apr -31 Oct 2021 were given with reasons:-

a) Transfer of domain of society website from the previous vendor and hosting it on BLUE STAR – Rs 25000/-

b) Web site transfer and related task expenditure paid to Col JS Virk – Rs 10,277/-

c) Elect Bill for May, July – Rs 71,600

d) Final payment for road repair – Rs 1,50,000/-

e) Repair of one Transformer – Rs 1,07,380/-

f) Servicing cum OH of three transformers -71,250/-

g) Repair of second transformer -71,000/-

h) Water and sewerage charges -1,67,864/-

i) Payment of legal Expenses – Rs 30,000

j) Payment of Roof repairs in an old o/s case – Rs 93,250/-

k) Purchasing of LED(18) Street Light – Rs 19,273/-

Total – Rs 816894/-

4. Details of outstanding dues from members were given to the house as under:-

a) Annual Maint Charges:- A total of 51 members have varying amounts outstanding totaling to a sum of Rs 7,53,600/- long o/s dues were of Maj KS Brar has sold the flat of someone on the power of Attorney and where about of both are not known. AWHO when approached has opined that it was an internal matter of the Society. The status of the flat which has been locked for many years is not good and it may become a cause of concern to neighbor’s causing major damages. After discussion, the house agreed that the flat is taken over by management, renovated, and offered for rent. The income after deducting all service charges be credited towards the o/s dues. A resolution to this effect was passed and is given at the end of these minutes. Meanwhile efforts are continued to recover the dues from all others.

b) Share of each member towards the payment of charges to HSVP for approval of REVISED PLAN-19 COMES TO Rs 16,800/- and a total of 51 members have yet to pay in full or part amounting to a total of Rs 789525/- . This amount includes Rs 86325.- on account of the compounding fee also. After detailed deliberations, the house came to the conclusion that a demand notice be served on all and subsequent legal action be initiated. A resolution passed unanimously is given at the end of these minutes.

c) The house was informed that AMC charges for lifts were due from 01 Nov 2021 and C,D,E.J,L,N and S Blocks have yet to pay. Efforts were to continue and henceforth wef 01 May 2022 charges will be taken annually and not six monthly.

5. Status of court cases at various forums was intimated to the house with the next date of hearings. A total of 14 current active cases are running. The house was informed that Col JS Kahlon who is the nominated legal advisor to the society has been giving free legal advice voluntarily. Further, he has been taking up the cases in courts at a very notional amount of Rs 3,500/- per case. The house unanimously applauded his dedication to the welfare of society. Few cases were read out briefly for the benefit of the house to understand the nature of cases that the society is facing.

6. Issue of new car stickers. The house was informed that about 10% of members have yet to collect them. They are being persuaded to do so.

7. Point from members:-

a) Lt Col LS Bedi:-

i) Inform the General body total profit of the society since 1998 and get the approval of declaring and paying the share of profit to the members. The house was apprised of the fact that this being a maint society is run on the contributions of members as specified from time to time and is not a commercial establishment. Therefore whatever is left as balance at the end of F Y is taken to the next year in the general fund. Till date, the question of profit has not been there.

ii) Please inform the General body as to why Lt Col JS Kahlon (Retd) has been kept as member of the society when he was expelled from the member ship on 22.03.2011 by the society on the order of Dy Registrar(HQ),coop society, Haryana in petition no 333/2008. The house was informed that the expulsion has to be on a resolution of GBM which has to be ratified by Registrar and none else. There is no resolution of such nature on record and hence the contention of Lt Col LS Bedi is wrong.

b) Lt Col GPI Singh of J-143. The member wanted a dedicated place for his two-wheeler to be marked on ground as his allotted place has been covered by the construction of lift. He has been assured by the management of doing the needful.

c) Miss Geeta Singwal of O-221. The member raised the issue of seepage in her ceiling from the upper floor flat. It was decided by the house that a team will visit her flat and see the status on ground, have consultations with both and resolve the issue amicably as per the principles of community living.

8. Points from management:-

An advisory received from HQ, AWHO, on renovation, unauthorized construction etc. was read out to the house. The main emphasis was on prior permission to be taken from MC by members to undertake any type of renovation/construction etc so as to ensure that no unauthorized job is done which can lead to cracking of the structure.

(b) House was informed about the outstanding rent dues from shop no 1 and 3 to the tune of Rs 88,114/- and Rs 96,619/- respectively. The house approved the proposal of MC to give them one last chance, failing which the shops be sealed, with security and stocks forfeited.

(c) Long pending case of lift installation in U-Block was discussed in detail. Since members of T-Block have out rightly refused to share their lift with U-Block, they were permitted in principle to go ahead with installation of an independent lift and submit a proposal for the same. Exact spot of it will be allotted by the MC.

(d) Salary of staff. The staff has asked for an increase which the MC has turned down due to lack of resources and that it is effected from 01 apr. The house was in agreement and it was decided that it would be considered on 01 Apr 2022.

9. RESOLUTION (Refer para -4(a) minutes on page -142). “There is an outstanding amount of Rs 1,36,800/- excluding interest wef 2003 on account of maintenance charges against Maj KS Brar (now Col) for Flat No V-314. HQ AWHO was approached to resume the flat since where about of Maj KS Brar could not be ascertained in spite of all out efforts. AWHO has directed the MC to proceed with the case at society level vide their letter No B/03001/55/AWHO/Mahander Vihar dt 01 Sep 2015. Accordingly. Agenda point regarding recovery of maint charges against Flat No V-314 was put up before the GBM held today. The house has unanimously resolved to take over the flat possession, assess the expenditure required to repair the same. After repairs it should be rented out and the proceeds be used for meeting the expenditure on repairs and then the o/s amount”.

10. RESOLUTION. (Ref para-4(b) of Minutes on page -142). To get the revised plan(RP-19) approved from HSVP, so that the increase in FAR by Govt of Haryana can be fully utilized by the resident members, the society paid a sum of Rs 55,49,715/-Lac to HSVP. The individual share of each member came to Rs 16,800/- and the same was approved by the GBM held on 02 Jun 2019. More than 280 members out 332 have already paid their share. More than two year have passed and the rest of members have still not paid their full share in spite of repeated reminders. Issue of recovery of these o/s dues was raised before the house in GBM held today. The house while exercising power under bye law-31 read in conjunction with HAOA Sec-7 and sec-17 resolved to charge an interest of 10% per year from the date on which payment was made to HSVP by the Society, ie 25 Jun 2019. If the payment is not cleared by 30 Nov 2021, a demand notice be served on the members and as per provisions of law proceedings be initiated”.

11. There being no other points, a vote of thanks was passed and the meeting closed at 1530hrs.
